Terms of Use
Effective: 10 October 2026
1. Who we are and what these terms cover
PlayKo is an app that helps people find, organise and join sports games, clubs and groups, and talk to each other. It is provided by:
Amit Raj
Möllendorffstraße 7
10367 Berlin
Germany
E-Mail: hello@playko.app
Phone: +49 174 4789991
("we", "us"). These terms apply to your use of the PlayKo app and its services. You accept them when you create your account. Our Privacy Policy explains how we handle your data. The PlayKo Covenant describes additional promises we make to people who build communities on PlayKo.
2. Your account
- You must be at least 16 years old.
- Give accurate information — in particular your real name or the name you are known by, and a correct gender where games depend on it. One person, one account; accounts may not be shared, sold or transferred.
- Keep access to your phone number and sign-in method secure. Tell us at hello@playko.app if you think someone else is using your account.
- Your @handle must not impersonate anyone or infringe others' rights. We may change or reclaim a handle that does.
3. The service
PlayKo is free to use. We provide the platform and develop it continuously, so features may change or be discontinued, as long as this is reasonable for you. We aim for PlayKo to be available at all times but cannot guarantee uninterrupted availability (e.g. during maintenance or for reasons beyond our control). If we ever introduce paid features of our own, we will tell you clearly in advance, and nothing will be charged without your explicit agreement.
4. Games and playing together
- Games are created and run by their hosts and clubs, not by us. We are not the organiser of any game and do not check venues, equipment or other participants.
- You take part in sport at your own risk and are responsible for your own health, fitness, equipment and insurance, and for following the rules of the venue.
- A "yes" is a commitment. If you confirm a spot, come — or cancel in the app as early as possible so someone else can play. Late cancellations and no-shows are recorded and form a private reliability signal (see the Privacy Policy, section 3.3). Hosts may decline requests, manage waiting lists and remove participants for good reason.
- Respect the game rules set by the host, including women-only games and minimum numbers of women in mixed games. Do not misrepresent your gender or level to get into a game.
- Level confirmations ("vouches") and "props" must be honest and based on actually playing together.
5. Clubs
Club owners and admins are responsible for their club, its games, decisions about members and the content they post as the club. They must respect these terms and the PlayKo Covenant. Club ownership can be transferred and clubs can be closed through the in-app process.
6. Payments for club memberships
Some clubs charge membership fees through PlayKo. The payment is processed by Stripe directly on the club's Stripe account. Your membership contract is with the club, not with us: the club sets the price, terms, cancellation and refund rules and is responsible for them. PlayKo charges no fee and is not a party to that contract. Stripe's terms apply to the payment. Questions about refunds go to the club; if you cannot reach an agreement, contact us and we will try to help.
7. Your content
- You keep all rights to what you post (photos, videos, messages, stories, moments, comments).
- You grant us a non-exclusive, royalty-free, worldwide licence to store, host, reproduce, technically adapt (e.g. resize, compress) and display your content, only to the extent needed to run PlayKo and show the content to the people you share it with. The licence ends when you delete the content or your account, except for content others have already received (e.g. messages in a chat) and for backups until they are overwritten.
- Only post content you have the right to share. You are responsible for your content — including that people shown in your photos or videos agree to being shown.
8. Prohibited conduct
There is no tolerance for objectionable content or abusive users. You must not:
- harass, bully, threaten, stalk or intimidate anyone, or share someone's private information without consent;
- post hate speech or discriminate based on origin, ethnicity, religion, gender, sexual orientation, disability or age;
- post sexual content, nudity, violent or gory content, or anything that sexualises minors (we report such content to the authorities);
- post illegal content or promote violence, weapons, drugs, self-harm or other illegal activity;
- impersonate people or clubs, create fake accounts, or mislead others about who you are;
- send spam, advertising, chain messages or scams, or use PlayKo commercially without our consent (clubs organising their own activities are fine);
- infringe copyrights, trademarks or other rights;
- create games you do not intend to hold, or abuse RSVPs, reports, vouches or props;
- access PlayKo by automated means (scraping, bots), circumvent security measures or limits, or interfere with the service;
- use another person's account, or keep using PlayKo after we have suspended you.
9. Reporting, blocking and moderation
- You can block any user and report users, content, games and clubs in the app. Anyone can also report illegal content to hello@playko.app, stating where it is and why it is illegal.
- We review reports promptly and may use automated tools to detect prohibited images. If content or behaviour breaks the law or these terms, we may remove or hide content, restrict features, suspend or permanently close accounts, or remove games or clubs. We act proportionately, taking into account how serious and how repeated a violation is.
- When we restrict you or your content, we tell you what we did and why (unless we are not allowed to, e.g. during an investigation by the authorities). You can object to any decision by writing to hello@playko.app; a person will review it. Your rights under the EU Digital Services Act, including out-of-court dispute settlement and going to court, remain unaffected.
10. Ending the contract
- You can delete your account at any time in Settings → Delete account. If you own a club, transfer it or close it first.
- We may end the contract with two weeks' notice, for example if we discontinue PlayKo. We may suspend or close an account without notice for good cause — in particular serious or repeated breaches of these terms, illegal content, or a risk to other users' safety.
- What happens to your data after deletion is described in the Privacy Policy (section 7).
11. Liability
- We are liable without limitation for damage caused intentionally or by gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee.
- For slight negligence we are only liable if we breach an obligation that is essential for the proper performance of the contract and on which you may regularly rely ("cardinal obligation"); in that case our liability is limited to the foreseeable damage typical for this type of contract.
- Otherwise our liability is excluded. This also applies to the personal liability of our employees, representatives and agents.
- We are not responsible for what other users do or post, or for games, clubs and venues organised by others, except where we are liable under the rules above (e.g. if we fail to act on illegal content we know about).
12. Changes to these terms
We may change these terms if there is a valid reason (e.g. new features, changes in the law or case law) and the change is reasonable for you. We will notify you in the app at least two weeks before changes take effect. If you do not agree, you can delete your account before then. Changes to essential parts of the contract require your explicit consent.
13. Applicable law and disputes
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer living in another EU country, you keep the protection of the mandatory consumer law of that country. If you are a merchant, the courts at our place of business have exclusive jurisdiction.
We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board. (The EU online dispute resolution platform was discontinued on 20 July 2025.)
14. Final provisions
If a provision of these terms is invalid, the remaining provisions stay in force and the statutory rules apply instead. The German version of these terms is binding; the English version is a translation for your convenience.
